      Even though no one is required to prepare a will, having a will can avoid some family conflict and any confusion when dividing the decedent's estate. The State of Texas will divide the decedent's estate based on Texas intestacy laws, which dictate how the deceased estate is divided within their family.  The intestate process may be an expensive and overwhelming experience for the decedent's family.

       The Dabney-Norman Law Firm prepares power of attorney forms for clients who are living and need to appoint someone to take care of their personal affairs.  A power of attorney is a legal document that allows someone of your choosing to make a wide variety of decisions on your behalf.  

 

1. Durable/Statutory Power of Attorney:  This POA is used when a person becomes incapacitated and cannot make financial, property, and investment decisions for themselves.  They will appoint a trusted individual to make financial, property, and investment decisions for them.  A Durable/Statutory POA may be revoked at any time.

2.  Medical Power of Attorney: This POA is used when a person becomes incapacitated and cannot make medical decisions for themselves.  They will appoint a trusted individual to make decisions about their healthcare, including end-of-life planning if necessary.  A medical POA may be revoked at any time and may have limitations.
